Do Today — Terms of Service

1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and Black Health Intelligence Pty Ltd (ACN 693 026 112, ABN 23 693 026 112), trading as Do Today ("Do Today", "we", "us", "our"). By creating an account, subscribing, or otherwise accessing or using Do Today — including the website at dotoday.com.au, the web app, the @dotoday_abraham_bot Telegram companion, and the Do Today MCP server (together, the "Service") — you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility — 18+ only
You must be at least 18 years of age to use the Service, and you confirm you are 18 or over when you use it. Do Today is an adult product intended for people in a medically-supervised weight-management program. Access to the AI companion is age-gated: where your confirmed age is unknown or under 18, the Service will not proceed. We do not provide the Service to, or knowingly collect information from, anyone under 18.
3. What Do Today is
Do Today is a paid, conversational AI health companion. Through "Abraham", our AI companion, it helps you log and reflect on nutrition, hydration, activity, sleep, mood, medications, body metrics, and related health data, and it provides personalised insights, coaching, reminders, and suggestions. You can interact by typing or talking to Abraham, snapping a photo of a meal, scanning a barcode, or using voice input.
Do Today is designed to support you in between appointments with your treating practitioners. It complements — and does not replace — professional care.
4. Important health and medical disclaimer — please read
Do Today is not a medical device and does not provide medical advice, diagnosis, or treatment. Do Today is a wellness and information companion; it is not intended to diagnose, cure, monitor, predict, or treat any disease or condition. It supports — it does not replace — the care of your Nurse Practitioner, Dietician, or Psychologist.
- Abraham and all AI-generated content are for general wellness and informational purposes only. Abraham may summarise, reframe, and explain information in plain language, but it does not diagnose conditions, prescribe, or tell you to start, stop, or change any medication or treatment.
- Do Today is not a substitute for professional healthcare. Always seek the advice of your qualified treating practitioners — which for Do Today's supervised-program context are Nurse Practitioners, Dieticians, and Psychologists — before making decisions about your health, diet, exercise, or medications.
- AI can be wrong. AI-generated content may be inaccurate, incomplete, or not appropriate for your circumstances. Do not rely on it as your sole source of health information. Safety features (such as allergen and other warnings) are aids, not guarantees — the absence of a warning does not mean something is safe for you.
You are responsible for decisions you make based on the Service, and for discussing them with your practitioners.
5. Not a crisis or emergency service
Do Today is not a crisis, emergency, or mental-health monitoring service. Your conversations with Abraham are not monitored by a person in real time. Abraham includes automated safety prompts, but they are not a substitute for emergency help.
- If you are in a medical emergency, call 000 (Australia) immediately.
- If you are in crisis or thinking about harming yourself, call Lifeline on 13 11 14, or call 000.
Do not use the Service to seek urgent help or to report an emergency.
6. Your account
You must provide accurate information when you create an account, and keep it up to date. You are responsible for keeping your login credentials confidential and for activity under your account. Tell us promptly if you suspect unauthorised use. The Service is for your personal use — do not use it on behalf of another person, or share your account.
7. Subscriptions, billing, and cancellation
- Do Today is offered on a paid subscription of A$14.99 per month (all prices in AUD). Eligible patients of a partner clinic (currently Downscale) receive free access while their clinic's participation remains in effect (see clause 8). Current pricing is shown in the app and may change on notice.
- Payments are processed by Stripe. By subscribing you authorise us (via Stripe) to charge your chosen payment method on a recurring, auto-renewing basis each billing period until you cancel.
- You can cancel at any time from your account settings (Profile → Manage subscription), which opens the secure Stripe billing portal. Cancellation stops future charges and takes effect at the end of your current paid period — you keep access until then. You may reinstate a scheduled cancellation before the period ends.
- Except where required by the Australian Consumer Law or stated otherwise, fees already paid are non-refundable and we do not provide partial-period refunds. Nothing in this clause limits your rights under the ACL (clause 12).
- If we offer a free trial or free introductory messages, the terms of that offer (what it includes and what converts to paid) are as described at sign-up.
- We may change pricing or plans. We will give you reasonable notice of changes affecting your current subscription, and price changes apply from your next renewal.
8. Clinic-provided free access
If you access Do Today for free through a partner clinic, that free access is provided through your clinic and depends on your clinic's participation in Do Today. Your free access can end if:
- your clinic's licence or subscription lapses, is cancelled, or is not renewed; or
- your clinic removes, suspends, or otherwise ends your access as its patient.
If your clinic-provided access ends, you may continue using Do Today by taking out the individual paid subscription described in clause 7. Free clinic access is not a personal entitlement and is not transferable.
9. Acceptable use
You agree not to:
- use the Service for any unlawful purpose, or in breach of these Terms;
- rely on the Service for medical diagnosis, emergency, or crisis purposes;
- attempt to gain unauthorised access to the Service, other users' data, or our systems;
- interfere with, disrupt, overload, or probe the Service or its security;
- upload malicious code, or attempt to exploit vulnerabilities;
- scrape, harvest, or extract data other than your own, or use automated means against the Service outside the tools we provide (for example, our MCP server used with your own account);
- reverse-engineer or misuse the AI, or use it to generate unlawful, harmful, or infringing content;
- share your account or use the Service on behalf of another person without authorisation; or
- enter information about other people without a proper basis to do so.
We may suspend or terminate access for breach of this clause.
10. Your content and data
- You own the health data and content you enter. You grant us the licence we need to host, process, and use your content solely to provide and improve the Service to you and as described in our Privacy Policy — including the overseas AI processing described there, for which we obtain your express consent.
- You are responsible for the accuracy of what you enter, and for having the right to enter it.
- We handle your personal and health information as set out in the Privacy Policy, which forms part of your agreement with us. We do not sell your data, and we do not use it to train our own models.
11. Our intellectual property
The Service, including Abraham, the software, designs, text, and branding (but excluding your content), is owned by Black Health Intelligence Pty Ltd or its licensors and is protected by Australian and international intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose while your account is in good standing. You may not copy, resell, or create derivative products from the Service except as we expressly permit.
12. Third-party services and links
The Service relies on third parties — including Supabase (data hosting, in Australia), Vercel (application hosting and AI gateway), Stripe (billing), Resend (transactional email), our AI-model providers (Anthropic and OpenAI, including OpenAI's Whisper transcription and embedding services), Tavily (web-search lookups), and Telegram (only if you choose to connect it) — and may link to external resources. We are not responsible for third-party services or content, and your use of them may be governed by their own terms. Your use of the AI companion involves processing by overseas AI providers as described in the Privacy Policy.
13. Australian Consumer Law and consumer guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the ACL where it would be unlawful to do so.
Where we are permitted to limit our liability for a failure to comply with a consumer guarantee (other than a guarantee that cannot be limited by law), our liability is limited, at our option, to: (a) re-supplying the service; or (b) paying the cost of having the service re-supplied.
14. Disclaimers and limitation of liability
- The Service is provided "as is" and "as available". To the maximum extent permitted by law (and subject to clause 13), we do not warrant that the Service will be uninterrupted, error-free, or that AI outputs will be accurate, complete, or fit for a particular purpose.
- To the maximum extent permitted by law, and subject to clause 13, Black Health Intelligence Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss arising from your reliance on AI-generated content, decisions you make about your health, or from service interruptions.
- To the maximum extent permitted by law, and subject to clause 13, our total aggregate liability to you for any claim connected with the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
- Nothing in these Terms limits liability that cannot be limited by law (including for death or personal injury caused by our negligence, or fraud).
15. Service availability and changes
We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features, and we may change these Terms. If we make material changes, we will give reasonable notice (for example, in-app or by email) and, where a change materially affects your rights, your continued use after the change takes effect constitutes acceptance. If you do not accept a change, you may stop using and cancel the Service.
16. Termination
- You may stop using the Service and delete your account at any time. Deleting your account erases your data as described in the Privacy Policy and cancels any active paid subscription.
- We may suspend or terminate your access if you breach these Terms, if required by law, or if we discontinue the Service (with reasonable notice where practicable).
- On termination, your licence to use the Service ends. We handle your data after termination in accordance with the Privacy Policy, including deletion of your health data on account deletion, subject to minimised accountability records and legally required retention.
17. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of New South Wales (and courts able to hear appeals from them). Nothing in this clause prevents you from bringing a claim in another Australian jurisdiction where the law gives you that right (including under the ACL).
18. General
- Entire agreement: these Terms and the Privacy Policy are the whole agreement between us about the Service.
- Severance: if any provision is unenforceable, the rest continues in force.
- No waiver: if we do not enforce a right, that is not a waiver of it.
- Assignment: you may not assign these Terms without our consent; we may assign them in connection with a business transfer, subject to protections at least equivalent to these Terms.
